Our Service to You:
1. Definitions & Law
The contract is the document or documents that set these conditions and all other details about the client’s agreement with us. "WE" and "US” means the supplier of goods or services (MYTVONLINE (UK) LTD) of which educ8tv is a trading name, "CLIENT” means the person, persons or Customer. "EVENT" means the service the client has booked. These conditions will be governed by and interpreted in accordance with the English law. These conditions do not affect the statutory rights as a consumer as defined by the "Unfair Contract Terms act 1977 or any statutory amendments of that act.
2. Rights reserved
Any failure by us not to enforce any or all of these conditions shall not amount to or be interpreted as a waiver of any of our rights. By booking educ8tv a trading name of MYTVONLINE (UK) LTD for an advert/video based web site the client is accepting these terms & conditions.
3. Special Requests/Coverage
The client understands and accepts that the video coverage will be as the videographers professional expertise determines and that no one shot/scene will be deemed more important than another. Special requests are not binding instruction, although every effort is made to comply with the client’s wishes.
4. Limit of our liability
We will not be liable for any delays caused by circumstances, which are beyond our reasonable control. We will not be liable for any radio signal losses, battery failures, equipment failure and or material defects, which are beyond our control. Any refunds for the EVENT will be limited to no more than the original deposit. In the unlikely event of a total video failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
5. Force Majeure or Act of God
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
6. Copyright / Display
The copyright of the goods will remain with us until full payment is received, thereby copyright is transferred to the client. The client hereby allows educ8tv a trading name of MYTVONLINE (UK) LTD to display any images/video included in this contract in their studios, portfolios, literature, exhibitions, website and advertising. Raw footage remains the property of MYTVONLINE (UK) LTD and will not be released to the client under any circumstances.
7. Payment
7.1. Payment Methods
The payment methods accepted will be Standing Order, Cheque, credit card or bank transfer unless otherwise agreed at time of contract.
7.2. Balance
Payment of the outstanding balance is required no later than 30 days before the date the client agrees to hire us. If paying by cheque please allow extra time for it to be processed and to clear.
7.3. Sending Cash
We strongly advise against sending cash by post, as we cannot be held responsible for any damage or loss of money that is sent by this method. If the client does decide to send cash by post it is solely at the client’s own risk.
7.4. Discounts
Discounts are applied at our discretion and are not an entitlement.
7.5. Failure to pay / Cancellation
Where a contract / standing order agreement has been organised it is imperative that the client adhere to the agreement and supplies payment by the due date for the contract. Failure to pay by the agreed schedule will result in the full amount becoming due and recoverable, together with late payment charges inline with the current Bank of England Guidelines.
8. Cancellation
Bookings, once accepted, cannot be cancelled. However, there is a 10-day cooling off period from date of order, which must be acknowledged by the Customer in writing. Anything received after this time will be subject to a cancellation fee representing the full cost of the order. Once filming has been booked into the MYTVONLINE (UK) LTD diary, a client must provide at least seven days notice of cancellation or a daily rate of £250 for each day affected will be added to the original agreed price.
9. Errors
Any errors or defects on the product supplied, which is our fault will be remedied free of charge. By booking the EVENT with us the client is agreeing to let us film and edit using our judgment and artistic license. The client in relation to the material, locations used and final editing, shall grant the videographer artistic license. The client, PRIOR to the event, shall deem the videographer’s judgment regarding locations and final editing correct, unless previously discussed with the client and agreed in writing.
10. Amendments
On all projects, a ‘draft’ version of the production will be forwarded to the client for their review. The draft may receive one set of revisions only, which is included in the original agreed cost. Subsequent amendments thereafter will incur an additional hourly rate of £30 + VAT. It is the responsibility of the client to ensure all amendments are documented fully and clearly in writing to MYTVONLINE (UK) LTD.
11. Complaints
Any complaints should be raised by the client with educ8tv at MYTVONLINE (UK) LTD, in writing, within 28 days of receiving the product.
12. Photos / Music / Media
Any items sent to educ8tv a trading name of MYTVONLINE (UK) LTD must be clearly labeled with the clients name and return address. Whilst every care is taken, customer’s material is accepted on the basis that their value does not exceed the retail cost of the material itself. Liability for loss or damage is therefore limited to the replacement of such material.
13. Filming
Additional charges to the original agreed price will be added if camera operators from MYTVONLINE (UK) LTD are required to make more than one visit to any location requested by the client. The client will be charged at a daily rate of £250 for every day’s filming thereafter.
14. Operator requirements and working hours
If the camera operator is to film for longer then 4 hours then they will take a break for refreshment at an appropriate time left to their discretion. Camera operators are in attendance at the client’s request and must be shown due respect and courtesy at all times. This will enable them to carry out their work in a professional manner. If at any time or for any reason a camera operator feels that they are being mistreated or receiving abuse of any nature, they reserve the right to leave without notice. The camera operator’s working day is 7.5 hours. If filming exceeds that, an hourly rate of £30 for each hour worked thereafter will be added to the original agreed price.
15. Non Attendance / Videographer
On occasions and without notice it may be necessary for the videographer originally specified to be substituted by another videographer, (e.g. due to ill health, circumstances beyond reasonable control).
16. Colours / Lighting / Sound
While every effort will be made to ensure accurate colours and lighting reproduction, in certain conditions the colours and the lighting may not be accurately reproduced. This is not a fault but a limitation of the factors on the day, which are beyond our control. E.g. mixed indoor & external lighting, harsh shadows, and poor lighting conditions. Sound will be captured as accurately as possible within the limitations of the Event and the equipment used.
17. Camera Positions / Authority / Permissions to Video
Every effort will be made to get the best position for the camera to video the Event. However, due to possible restrictions imposed upon us on the day, this may not always be achievable. The client must obtain permission to film at the appointment location (church, park, etc) from the relevant authorities, and the client is responsible for any fees that may be levied by such authorities. Educ8tv a trading name of MYTVONLINE (UK) LTD will not be responsible for any refusal by such authorities to allow filming to be carried out. The client should produce the relevant photographic/video release forms from all people involved in filming and seek permission to use their image where appropriate.
18. Travel Costs
A charge of between 2.5 per cent and 5 per cent will be added to the order value to cover travel and accommodation expenses. Please ask our sales consultant about this when booking. This is non-negotiable.
19. Completion / Delivery / Postage
Completion is usually between 8-10 weeks from the date of the event (not including any bank holidays and depending on seasonal trends and current workload). The product/s should be ready to view online or delivery can be arranged at the clients preferred location. If all the information and items required to complete the video are not with educ8tv at MYTVONLINE (UK) LTD by at least the event date, then the completion time may increase and editing will be done when possible at our discretion.
If after 6 months from the date of the event, the materials and, or information required to finish the video is not forthcoming, then the service will have expired and a charge made for any subsequent editing, which will be advised by the client services manager.

21. Updates
We reserve the right to alter any part of this document, our website, literature and promotional/advertising material at any time and without notification.
22. Rights
These Conditions do not affect the client’s statutory rights.
